La loi n° 2016-1321 du 7 octobre 2016 pour une République numérique (LRN) , entrée en vigueur le 9 octobre 2016, propose l’introduction de deux articles fondamentaux pour la recherche publique et l’avènement de la science ouverte : - l’introduction dans le Code de la recherche d’un droit d’exploitation secondaire des publications scientifiques au profit des chercheurs (article 30) ; - la création de deux nouvelles exceptions dans le Code de la propriété intellectuelle, au droit d’auteur et au droit du producteur de bases de données, autorisant le text and data mining (TDM) à des fins de recherche publique (article 38).
La définition précise du périmètre d’application de ces dispositions est nécessaire à la sécurisation des pratiques de partage de la science.
Dans cet objectif, la présente analyse systémique propose d’identifier les dispositions légales et réglementaires applicables aux trois concepts pivots de la science ouverte que sont les notions de « plateforme », « écrits scientifiques » et « données de la recherche », ainsi qu’aux relations entre ces concepts : - « plateforme », « écrits scientifiques » et « données de la recherche » sont régis voir introduits par la loi pour une République numérique (article 30 et 38 ainsi que les articles 49 à 51) , mais également par d’autres dispositions telles que le Code de la propriété intellectuelle, le décret constitutif du CNRS, le Code de la recherche ou encore le Code de l’éducation. Les obligations associées à ces concepts, comme l’obligation de loyauté des plateformes telle qu’affirmée par la LRN , sont également utilisés dans d’autres domaines du droit (principe de loyauté de la preuve ; - les relations entre ces trois concepts forment également des régimes juridiques autonomes : open access, open data, informations scientifiques et techniques, open process ; - le système global formé par ces concepts et relations devant aboutir à l’open science.
Cette analyse systémique permet de mettre au jour les écarts, les contradictions, les restrictions, les imprécisions aux fins de formuler des recommandations de sécurisation et d’encadrement : - sécurisation des dispositions légales par décrets : au-delà de l’application de l’article 38 sur les conditions de mise en œuvre du text and data mining, il est proposé de préciser certaines expressions aux fins de limiter les divergences d’interprétation ; - sécurisation des pratiques par un guide d’application et de bonnes pratiques à destination des chercheurs ainsi que par des sessions de formation et de sensibilisation ; - encadrement des pratiques par l’établissement d’une charte éthique et d’un contrat type de publication scientifique ; - supervision par une Agence de la Science ouverte garante des valeurs de la Science ouverte et porteuse des besoins de la recherche au niveau européen, notamment dans le cadre des discussions relatives à la proposition de directive sur le droit d'auteur dans le marché unique numérique, ainsi qu’au niveau international, après d’instances comme l’Organisation des Nations unies pour l'éducation, la science et la culture.Note de contenu : 1 - Identification des concepts pivots

[Termes IGN] web sémantiqueRésumé : (auteur) Assessing the quality of the main linked data sources on the Web like DBpedia or Yago is an important research topic. The existing approaches for quality assessment mostly focus on determining whether data sources are compliant with Web of data best practices or on their completeness, semantic accuracy, consistency, relevancy or trustworthiness. In this article, we aim at assessing the accuracy of a particular type of information often associated with Web of data resources: direct spatial references. We present the approaches currently used for assessing the planimetric accuracy of geographic databases. We explain why they cannot be directly applied to the resources of the Web of data. Eventually, we propose an approach for assessing the planimetric accuracy of DBpedia resources, adapted to the open nature of this knowledge base. [Termes IGN] regroupement de donnéesRésumé : (auteur) Socioeconomic and health analysts commonly rely on areally aggregated data, in part because government regulations on confidentiality prohibit data release at the individual level. Analytical results from areally aggregated data, however, are sensitive to the modifiable areal unit problem (MAUP). Levels of aggregation as well as the arbitrary and modifiable sizes, shapes, and arrangements of zones affect the validity and reliability of findings from analyses of areally aggregated data. MAUP, long acknowledged, remains unresolved. We present an exploratory spatial data analytical approach (ESDA) to understand the scalar effects of MAUP. To characterize relationships between data aggregation structures and spatial scales, we develop a method for statistically and visually exploring the local indicators of spatial association (LISA) exhibited between a variable and itself across varying levels of aggregation. We demonstrate our approach by analyzing the across-scale relationships of aggregated 2010 median income for the State of Pennsylvania and 2005–2009 cancer diagnosis rates for the State of New York between county–tract, tract–block group, and county–block group level US census designated enumeration units. This method for understanding the relationship between MAUP and spatial scale provides guidance to researchers in selecting the most appropriate scales to aggregate, analyze, and represent data for problem-specific analyses. Ces références spatiales sont un moyen favori pour interconnecter et visualiser les ressources sur le Web de données. Cependant, les hétérogénéités des niveaux de détail et de modélisations géométriques entre les sources de données constituent un défi majeur pour l’utilisation de la comparaison des références spatiales comme critère pour l’interconnexion des ressources. Ce défi est amplifié par la nature ouverte et collaborative des sources de données du Web qui engendre des hétérogénéités géométriques internes aux sources de données. En outre, les applications de visualisation cartographique des ressources géoréférencées du Web de données ne fournissent pas une visualisation lisible à toutes les échelles.Dans cette thèse, nous proposons un vocabulaire pour formaliser les connaissances sur les caractéristiques de chaque géométrie dans un jeu de données. Nous proposons également une approche semi-automatique basée sur un référentiel topographique pour acquérir ces connaissances. Nous proposons de mettre en oeuvre ces connaissances dans une approche d’adaptation dynamique du paramétrage de la comparaison des géométries dans un processus d’interconnexion. Nous proposons une approche complémentaire s’appuyant sur un référentiel topographique pour la détection des liens de cardinalité n:m. Nous proposons finalement des applications qui s’appuient sur des données topographiques de référence et leurs liens avec les ressources géoréférencées du Web pour offrir une visualisation cartographique multiéchelle lisible et conviviale.
